(REHOBOTH BEACH, Del.) - The process of cutting down overgrown trees and shrubs at a home in the private community of Seabreeze began today.
The Homeowner's Association believed homeowner Marshall Townsend Jenney was violating a deed restrcition related to obstructing the view of the bay.
Jenney is the great-grandson of the late Gov. John G. Townsend Jr.
After five years of fighting, Jenney followed the courts order to cut down the landscapping by June 30th.
When WRDE knocked on the bayfront home, it appeared no one was home.
But as we walked away, he opened the door and said we were on his private property and told us to not come back.
Neighbor and former President of the HOA, Michael Vincent is standing behind Jenney.
"It's just not fair for one person to be singled out. Treat everyone the same or let's change the covenants. That's where I'm at, let's change the covenants because there are too many violations and they're outdated,"explained Vincent.
The judge hopes Jenney and the Homeowner's Association can get along in the future.
