Delaware prosecutors will now have to decide whether to have a new trial in the reversed official misconduct charge.
The court heard arguments Wednesday in the case of Kathy McGuiness, who was convicted last year on misdemeanor charges of conflict of interest, official misconduct and noncompliance with state procurement rules. A jury acquitted her on felony charges of theft and witness intimidation.
According to her lawyer, Steve Wood, former Delaware State Auditor Kathy McGuiness is appealing her 2022 conviction on the basis of being denied her right to a fair trial.
