DOVER, Del. – The Delaware General Assembly is reviewing three proposed bills addressing law enforcement cooperation, school resource officer responsibilities and police jurisdiction. 

House Bill 93, sponsored by Rep. Lynn seeks to restrict school resource officers and school constables from working with federal law enforcement agencies on immigration matters without approval from the Delaware attorney general. The bill is under review by the House Judiciary Committee.

House Bill 94, also introduced by Rep. Lynn, would prohibit law enforcement agencies from assisting federal immigration authorities at schools or churches without authorization from the attorney general. The legislation is currently assigned to the House Public Safety & Homeland Security Committee.

House Bill 104, sponsored by Rep. Yearick, proposes expanding police officers' statewide jurisdiction, including the ability for off-duty officers to make arrests under certain conditions. The bill would allow off-duty officers to arrest individuals for serious traffic offenses or crimes posing a substantial risk of injury, provided the officer is in a marked police vehicle. The measure also outlines notification requirements for officers acting outside their jurisdiction. The legislation, which requires a two-thirds vote for passage, is pending review in the House Judiciary Committee.
