GEORGETOWN, Del. - A federal judge on Tuesday issued a ruling to block President Joe Biden's policy, which sought to deny asylum to migrants arriving at the U.S.-Mexico border without first applying online or seeking protection in a transit country.
Víctor Hernández arrived in the United States 17 years ago and agreed with Biden's policy.
"Normally, I think it's not a law to remove it, but to always keep it as it is," Hernández said.
Immigration attorney Kevin Franco highlighted the practical impact of the judge's decision, advocating for migrants' right to apply for asylum upon reaching the U.S.-Mexico border.
"In practical perspective, the implications are that more people who are fleeing persecution will be eligible to apply for asylum, which they should be," Franco said.
However, Hernández expressed concerns about the potential increase in migrants directly coming to the border, suggesting it might lead to more suffering among those awaiting entry.
"The flow of people, for example, is going to increase too much, and perhaps in this country, it will not affect. Who is going to be affected is the people at the border because that is where they will suffer a lot," he said.
The judge has delayed his ruling from taking immediate effect, allowing the Biden administration to appeal, which they did on Tuesday.
