DELAWARE- The Delaware Department of Insurance has issued new guidance for insurers using aerial imagery and unmanned aircraft systems, such as drones, to assess properties.
Insurance Commissioner Trinidad Navarro announced the bulletin, which aims to ensure transparency and consumer protection as companies adopt aerial photography for claims processing, underwriting and loss assessments.
“Aerial imagery can improve efficiency, but it must be used fairly and ethically,” Navarro said. “This guidance ensures consumers are treated properly, and underwriting decisions are based on solid evidence—not just cosmetic factors.”
The bulletin clarifies that roof discoloration or streaking alone is not a valid reason for policy cancellation or nonrenewal. Insurers must provide clear evidence of significant damage that increases the risk of loss.
Additionally, the department emphasized that policyholders must receive proper notice and a specific explanation if aerial imagery contributes to a decision. Vague reasons such as “claims experience” or “increase in hazard” are not acceptable.
