DELAWARE -A lawsuit challenging the hiring of Rehoboth Beach’s Taylour Tedder as city manager will move forward. On Wednesday, Vice Chancellor Bonnie W. David in Delaware's Chancery Court ruled that the plaintiffs have stated a viable claim under the city’s charter.
The plaintiffs, a group of homeowners, are not disputing Tedder’s compensation — which includes a $250,000 annual salary and a $750,000 forgivable housing loan — but instead argue that the hiring process violated the city charter.
According to the David's decision, the Charter grants the Rehoboth Beach Commissioners the authority to appoint and determine the compensation of a city manager. However, the plaintiffs contend that Tedder's hiring does not meet certain qualifications required by the Charter. The court noted that the Charter’s language is ambiguous and that further proceedings will be needed to determine whether the hiring complied with the city’s legal requirements.
The lawsuit also alleged that the commissioners violated Delaware’s Freedom of Information Act, or FOIA, during contract negotiations. The judge dismissed those claims, ruling they were either filed too late or failed to state a valid legal issue.
The court’s decision means the plaintiffs’ challenge over the charter compliance will proceed, while the FOIA allegations will not. The parties have been directed to meet and confer on a proposed case schedule to move the case forward.
Local Rix Garey says he's worried the result will increase his taxes.
"My main concern is, if they have to get a new city manager and whether or not they can find a qualified person now that they've kind of open Pandora's box," said Garey.
CoastTV spoke with one local who says she thinks the lawsuit is unnecessary and that Tedder's hiring process was likely no different than the city manager's before him.
Garey though, thinks the concern is valid.
"They need to make sure that they vet him and make sure that he is qualified, make sure they crossed all their T's, dotted all their I's when they did the hiring process," said Garey.
