REHOBOTH BEACH, Del. - Two companies involved in the development of Osprey Point are now at odds in court. On Friday, May 23, NV Homes filed a 27-page lawsuit against Osprey Point Preserve, LLC.

In a lawsuit exclusively obtained by CoastTV, NV Homes is demanding that Osprey Point Preserve LLC submit a detailed engineered plan for the marina and beachfront amenities, features some neighbors say were in promotional materials and promised to future residents.

Some homeowners tell CoastTV that those beach amenities were what drew them to buy in the community and homeowners say contributed to rising home prices.

But today, the proposed marina and beachfront area remain untouched.

That frustration prompted residents to launch a website, ExposingNVHomes.com, and to put up a sign calling out NV Homes. The developer is now asking for that sign to be removed as part of the lawsuit.

Phil Lertora, a homeowner at Osprey Point, says the sign isn’t on NV Homes’ property—and the company has no legal ground to demand its removal.

"It’s our freedom of speech to kind of express where we stand," Lertora told CoastTV. "It's just embarrassing that they’re using legal means to try and force us to take it down."

Homeowners say they’ve contacted members of the Sussex County Council, as well as Gov. Matt Meyer and other First State officials, to raise their concerns.

Lertora says the legal battle could lead to more complications for locals down the road.

"They might build a few things, but we’ll have an angry developer who has to finish the community," he said. "I’m not sure that’s a recipe for satisfaction with anybody. So I don’t see this ending well on the current path."

CoastTV has reached out to both NV Homes, they did not comment on the matter.
