Arrest

SMYRNA, Del. - A detective with the Smyrna Police Department was arrested and charged on Monday with violations of federal child sexual exploitation laws.

Police say according to court documents, 33-year-old Michael Anthony Kealty distributed child pornography through his Snapchat account in Aug. of 2023. Federal agents executed a search warrant at his home on Sep. 22 of 2023. Police discovered additional child pornography in his Snapchat account.

Police say Kealty has been charged via Complaint with Distribution and Possession of Child Pornography. If convicted of distributing child pornography, Kealty faces a mandatory minimum penalty of five years in prison, with a maximum penalty of 20 years.  If convicted of possession, he faces a maximum penalty of 10 years.  A federal district court judge will determine any sentence after taking into account the U.S. Sentencing Guidelines and other statutory factors.

Police say David C. Weiss, U.S. Attorney for the District of Delaware made the announcement. Assistant U.S. Attorney Briana Knox is prosecuting the case. The department and the FBI Baltimore Field Office are investigating this case.

Chief of the department Torrie M. James released this statement:

"In late September, it was learned that federal authorities were investigating Michael Kealty, an officer from Smyrna PD for alleged crimes involving child pornography. This officer was immediately suspended, and all Police powers were removed.

The Smyrna Police Department has fully supported and cooperated in the ensuing investigation. On October 16th, 2023, I learned that Michael Kealty had been formally charged and detained. After receiving the full details of the investigation for the first time, Michael Kealty was immediately terminated from employment at Smyrna PD. His actions do not reflect the values of myself, my officers, or the profession of law enforcement. Nor do they conform to the mission statement of the Smyrna Police Department.

We will continue to cooperate with federal authorities as they prosecute this case. As Chief of Police, I am saddened, heartbroken, disappointed, and downright appalled by these allegations. The fact that one of my own officers has tarnished the reputation of our town and department is sickening.

As we continue to process and understand more about this situation, I ask that you remember that one person’s choices do not represent who we are as a police department, and we will continue to represent our town as professionals.

Thank you for your continued support."
